Who signs the geotechnical report, and why does that signature change everything?

There comes a moment in the process of commissioning a geotechnical study when almost nobody stops to think: when the report arrives, who has put their name at the bottom of the document? This is not a minor question. It is probably the most important question you can ask before accepting that dossier as valid. Because an incorrect—or absent—signature turns pages of technical data into worthless paper in front of any administration, insurer or judge.
Spain has a silent problem in the geotechnical study sector: the market is full of reports written by companies that subcontract the fieldwork to third parties, the laboratory testing to a third actor, and in the end affix the signature of someone who has not set foot on the plot and has not personally interpreted the data. The result is a document that has all the appearance of technical rigour but whose chain of responsibility is, at best, unclear.
To make sure this doesn’t happen to you, you need to understand three things: who has legal competence to sign, what the professional “visado” adds, and what that signature means in terms of real accountability.
Qualification is not an administrative detail
The geotechnical report is a technical document with direct legal effects on the structural safety of a building. That means that whoever signs it assumes a specific professional responsibility, and that responsibility can only be assumed by someone with the corresponding enabling qualification.
In Spain, the professionals with recognised competence to sign geotechnical reports are mainly geologists and engineering geologists—qualifications that specifically enable the recognition, analysis and interpretation of the subsurface. In certain contexts—especially in large-scale civil engineering works—road, canal and port engineers or technical engineers for public works may also be involved, always within their area of competence.
What an assistant surveyor (aparejador), a technical architect (arquitecto técnico) or a construction company without an enabled technical professional cannot do is sign a geotechnical report that is valid for attaching to an execution project. Even if it seems obvious, in practice documents are submitted that have been signed by profiles that do not have that competence, particularly in smaller works or in areas where municipal supervision is lax.

The Spanish Technical Building Code (Código Técnico de la Edificación, CTE) does not explicitly specify a single qualification, but case law and professional practice have consolidated that the geotechnical interpretation of the subsurface is the competence of geologists and engineering geologists. Any ambiguity on this point must be resolved by consulting the relevant professional body in your autonomous community before accepting the document.

The professional “visado”: the second layer of assurance
Knowing that the report is signed by a registered geologist is necessary, but not always sufficient. This is where the professional “visado” comes in: a control mechanism that many property owners do not know about, and which adds a very specific layer of assurance.
What is the “visado”?
The “visado” is the certification issued by the professional body of the signing technician, certifying that the professional is registered, that their qualification is the correct one, and that at the time the report is issued they do not have their professional practice suspended due to a disciplinary sanction. It does not validate the technical content of the report, but it does guarantee that the person signing it has the legal right to do so.
When is it mandatory?
The obligation to obtain the “visado” varies according to the autonomous community and the type of work. In many cases, the town hall or the architects’ college that supervises the execution project will require the geotechnical “visado” as a condition for admitting the document. If your architect asks you for it expressly, it’s not out of caprice: it’s because they know that without it the project may be rejected during processing.
What happens without the “visado”?
A non-visado report may be valid in some administrative contexts and completely useless in others. The problem is that you won’t know which of the two you’re in until you submit it and it is rejected. The simplest solution is to always require the “visado” from the outset, regardless of whether you think it will be necessary or not.

The case nobody wants to be the protagonist of
In a town in the province of Toledo, a property owner commissioned a geotechnical study through a renovation company that included the service as part of a package. The report arrived signed by a technician with a qualification in building engineering. The document looked good: professional cover page, data tables, photographs of the site.
When the architect tried to attach it to the execution project in order to submit it to the town hall, the municipal technician rejected it. The reason: the signatory’s qualification did not enable the geotechnical interpretation of the subsurface according to the criteria of the provincial architects’ college. The study had to be redone from scratch with a registered geologist. Additional cost: the full price of a second study plus a six-week delay in the processing of the project.
The property owner had paid twice for the same document. And the renovation company, which had subcontracted the study at the lowest price it found, assumed no contractual responsibility because the contract did not specify the qualification required for the signatory.

Three checks you should make before paying for the report
When you receive the geotechnical report, before accepting it and handing it to your architect, verify these three points:
- Name, qualification and the signatory’s registration number. They should appear on the cover page or on the first pages of the document. If only the company name appears but not the name of the responsible technician, the report has no identifiable signatory and lacks technical validity.
- Stamp and number of the professional “visado”. Look for the stamp of the relevant professional body, usually the Official College of Geologists or the Distinguished Official College of Geologists of your autonomous community. If it does not appear, ask explicitly whether the document has been “visado” and request the “visado” number so that you can verify it.
- Match between the signatory and the work carried out. The technician who signs must be the same person who directed and interpreted the study, not simply someone who lends their signature to a company. If you have any doubts, you can call the professional body directly and verify that the particular registered member is active and not subject to a suspension of practice.

A signature is worth more than a thousand data points
A geotechnical report can contain the most accurate data in the world: detailed stratigraphies, exhaustive laboratory tests, well-argued foundation recommendations. But if the signature at the bottom of the document does not correspond to an enabled and “visado”-stamped professional, all that technical content remains legally on hold.
The signature is not the final processing step of a technical document. It is its starting point as a valid instrument. It is the person who, before the law, before the professional body and before you, assumes that the data are real, that the interpretation is correct and that the recommendation is appropriate for your specific case.
